These Terms of Service ("Terms") govern your access to and use of the BeeQR platform, website, and related services ("Services") operated by BeeQR ("we", "our", "us").

By accessing or using BeeQR, you agree to be bound by these Terms.

1. Overview of Services

BeeQR provides a platform that allows users to:

• Generate and manage QR codes
• Link QR codes to digital profiles ("QR Profiles")
• Enable item identification, recovery, and information sharing
• Facilitate communication between item owners and third parties

BeeQR acts solely as a technology platform and does not participate in or control interactions between users or third parties.

2. Eligibility

You must be at least 18 years old or have permission from a legal guardian to use the Services.

By using BeeQR, you confirm that:

• You have the legal capacity to enter into these Terms
• All information you provide is accurate and up to date

3. User Accounts

You are responsible for:

• Maintaining the confidentiality of your account
• All activities that occur under your account

You agree to:

• Notify us immediately of any unauthorized access
• Not share your account credentials

We reserve the right to suspend or terminate accounts that violate these Terms.

4. QR Profiles and Public Information

4.1 Public Visibility

QR Profiles are designed to be accessed by third parties when a QR code is scanned.

You acknowledge that:

• Any information you include in a QR Profile may be publicly visible
• You are solely responsible for the content you choose to share

4.2 Content Responsibility

You agree not to include:

• Sensitive personal data you do not wish to be public
• Illegal, harmful, or misleading information
• Content that infringes on third-party rights

5. Finder Interactions

BeeQR may enable communication between:

• The owner of an item
• A person who scans a QR code ("Finder")

You acknowledge that:

• BeeQR does not verify the identity of users or finders
• BeeQR does not guarantee the return of lost items
• All interactions occur at your own risk

BeeQR is not responsible for:

• The actions or conduct of any user or finder
• Any disputes arising from interactions
• Any loss, damage, or failure to recover items

6. No Guarantee of Recovery

BeeQR provides tools to assist in item recovery, but:

• We do not guarantee that lost items will be found or returned
• We do not guarantee that QR codes will be scanned
• We do not guarantee cooperation from any third party

7. Payments and Purchases

If you purchase products or services:

• Payments are processed via third-party providers (e.g., PayPal)
• You agree to provide accurate billing information
• All prices are listed in AUD unless stated otherwise

We reserve the right to:

• Modify pricing at any time
• Refuse or cancel orders where necessary

8. Acceptable Use

You agree not to:

• Use BeeQR for illegal, fraudulent, or deceptive purposes
• Upload or distribute harmful, abusive, or unlawful content
• Harass, threaten, or harm other users or third parties
• Attempt to gain unauthorized access to systems, accounts, or data
• Interfere with or disrupt the platform or its infrastructure
• Upload malicious code, scripts, or exploits
• Use automated systems (including bots, scrapers, or crawlers) to access, extract, or interact with the Services without prior written permission
• Attempt to probe, scan, or test the vulnerability of the platform
• Use the Services in a way that could damage, disable, or impair functionality
• Use BeeQR to build or support a competing product or service

We reserve the right to investigate and take appropriate action, including suspension or termination of access.

9. Intellectual Property

All BeeQR content, including but not limited to its branding, software, design, and platform functionality, is owned by BeeQR or its licensors and is protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for their intended purpose.

You must not, except as permitted by law:

• Copy, reproduce, distribute, or commercially exploit any part of the Services
• Modify, adapt, or create derivative works based on the platform
• Access or use the Services in a manner intended to replicate or compete with BeeQR
• Use BeeQR branding, trademarks, or assets without prior written consent

Nothing in these Terms restricts any rights you may have under applicable law that cannot be excluded.

10. User Content License

By uploading content to BeeQR, you grant us a worldwide, non-exclusive, royalty-free licence to:

• Host
• Store
• Display
• Process

your content solely for the purpose of operating and improving the Services.

You retain ownership of your content.

11. Service Availability

We aim to provide reliable access, but:

• Services may be interrupted, delayed, or unavailable
• Features may change or be discontinued at any time

We are not liable for:

• Downtime
• Data loss
• Service interruptions

12. Limitation of Liability

To the maximum extent permitted by law:

BeeQR is not liable for:

• Loss of personal property
• Failure to recover lost items
• Actions of users or third parties (including finders)
• Indirect, incidental, special, or consequential damages

Our total liability is limited to:

• The amount you paid to BeeQR in the 12 months preceding the claim, or
• $100 AUD, whichever is greater

13. Indemnification

You agree to indemnify and hold BeeQR harmless from any claims, damages, losses, or expenses arising from:

• Your use of the Services
• Your content
• Your violation of these Terms

14. Termination

We may suspend or terminate your access if you:

• Violate these Terms
• Engage in unlawful or harmful behaviour

You may stop using the Services at any time.

15. Privacy

Your use of BeeQR is also governed by our Privacy Policy.

16. Changes to Terms

We may update these Terms periodically.

Continued use of the Services after changes are published constitutes acceptance of the updated Terms.

17. Governing Law

These Terms are governed by the laws of:

• New South Wales, Australia

You submit to the exclusive jurisdiction of its courts.
